Service Agreement
1. General Provisions
1.1. This document is an official public offer (hereinafter — "Offer") of Sole Proprietor Yunyk Oleh Pavlovych (hereinafter — "Contractor" or "Seller") and contains all essential terms for providing services for access to the SAM CRM software (hereinafter — "Services").
1.2. This Offer is a public contract in accordance with Article 633 of the Civil Code of Ukraine. Acceptance of the terms of this Offer is the payment for the Services by the Customer.
1.3. By accepting this Offer, the Customer confirms that they are familiar with its terms and fully and unconditionally accept them.
1.4. The Contractor has the right to make changes to this Offer unilaterally by publishing a new version on the website sam-crm.ai. Changes take effect from the moment of their publication.

3. Subject of Agreement
3.1. The Contractor undertakes to provide the Customer with access to the SAM CRM software in accordance with the selected tariff plan, and the Customer undertakes to pay for these services.
3.2. List of services provided:
- Access to the SAM CRM web platform
- Email analysis using artificial intelligence (AI)
- Search for clients and suppliers through AI search
- Sales funnel and task management
- Document creation and export (invoices, proformas, packing lists)
- Team collaboration (up to 3 participants on Pro plan)
- Email analytics and tracking
- Company data enrichment
- Technical support
4. Pricing
Pro Plan — $10 USD / month
Includes:

4.2. Free trial: New users get 14 days of free access to full Pro plan functionality. No credit card required.
5. Payment Terms
5.1. Payment for Services is made in advance for a monthly period through PayPal or Stripe payment systems.
5.2. The subscription is renewed automatically every month unless the Customer cancels it through their account before the billing date.
6. Refund Policy
6.1. The Customer has the right to a refund within 7 calendar days from the date of the first payment if the Services do not meet expectations.
6.2. To receive a refund, the Customer must contact sam@sam-crm.ai stating the reason for refusing the Services.
6.3. Refunds are made within 14 business days from the date of receiving the request using the same payment method that was used for the purchase.
7. Rights and Obligations
7.1. Contractor's obligations:
- Provide Customer with access to SAM CRM according to the selected plan
- Ensure service availability of at least 99% of the time during the month
- Ensure confidentiality of Customer data in accordance with Privacy Policy
- Provide technical support via email sam@sam-crm.ai
7.2. Customer's obligations:
- Pay for Services in a timely manner according to the selected plan
- Not transfer account access credentials to third parties
- Not use Services for illegal activities, spam, or copyright infringement
- Maintain confidentiality of account access credentials
8. Liability
8.1. The Contractor is not liable for damages caused by:
- Force majeure circumstances (natural disasters, war, terrorist attacks, etc.)
- Actions of third parties (hacker attacks, DDoS attacks)
- Customer's unauthorized use of access credentials
- Technical malfunctions of Customer's equipment or internet provider
8.2. The Contractor's maximum liability is limited to the amount paid by the Customer for the last month of using the Services.
9. Privacy and Data Protection
9.1. The Contractor undertakes to ensure the confidentiality of the Customer's personal data in accordance with Ukrainian legislation and SAM CRM Privacy Policy.
9.2. The Contractor uses modern data protection methods, including encryption (SSL/TLS), OAuth 2.0 for email access, and regular backups.

10. Term and Termination
10.1. The Agreement comes into effect from the moment of acceptance of the Offer (payment) and is valid until the subscription is terminated or the agreement is terminated by one of the parties.
10.2. The Customer may terminate the agreement at any time by canceling the subscription through their account.
11. Dispute Resolution
11.1. All disputes and disagreements arising from this Agreement shall be resolved by the parties through negotiations.
11.2. If no agreement is reached, the dispute is referred to the court in accordance with the current legislation of Ukraine.
